The Better Nanny — Nanny Service Agreement

1. Parties & Children in Care

This Agreement is entered into on ______ [Date] between:

Service Provider ("Nanny"): Ashley Rabon, The Better Nanny · Phone: _ · Email: _ Client ("Family"): __ · Phone: _ · Email: _____ Home Address: ________

Child's Name Age / DOB Allergies / Medical Notes

2. Services & Professional Standards

The Nanny provides attentive, engaged childcare including: supervision, safety, and age-appropriate care during all scheduled hours; educational engagement (letters, phonics, numbers, early learning); creative and active play (arts and crafts, floor play, outdoor time); meal and snack preparation and light tidying of child areas; a controlled media environment (only age-appropriate, parent-approved content); and character development (modeling kindness, respect, helpfulness).

Housekeeping beyond child-related tidying, errands, and pet care are not included unless separately agreed and compensated.

3. Care Policies

3A. Playdate & Additional Children. For additional children (playdates, siblings' friends): $15.00/hour per additional child added to the base rate; 24 hours' advance notice required; the Nanny must be able to speak directly with the additional child's parent and have emergency contact and allergy information before care begins. If the Nanny is supervising children, the Nanny is working and must be compensated — regardless of whether it's called a "playdate."

3B. Sick Child. The Nanny will care for: common colds (runny nose, mild cough), minor seasonal allergies, and children recovering and feeling better. The Nanny will not care for: fever over 100.4°F, vomiting or diarrhea, highly contagious conditions (flu, strep, hand-foot-mouth, pink eye, etc.), or any condition requiring constant medical monitoring. Common sense applies — a miserable child who needs a parent should stay home.

3C. Parent Presence. Once the Nanny is scheduled and at work, all scheduled time is billable whether or not a parent is present — including when a parent is home working, relaxing, or handling other matters. Scheduled care is reserved, professional time, like a daycare or preschool. A parent wanting a break at home during scheduled hours is perfectly fine — it is billable time.

5. Compensation

Payment terms: single shift/week paid day-of; multiple shifts/week paid end of week. Methods: cash (preferred), Venmo, Zelle, or __. Payment due on the agreed date; if more than 3 days late, services may pause until current.

6. Cancellation Policy

Notice Given Fee Due
More than 24 hours No charge
Less than 24 hours 50% of scheduled hours
Less than 2 hours (day-of) 100% of scheduled hours

Emergency exceptions (sudden illness, family emergency) considered case by case. If the Nanny must cancel, she provides as much notice as possible and offers a backup caregiver when available.

Guaranteed Hours (recurring weekly clients). For Families with a standing weekly schedule, scheduled hours are reserved professional time. If the Family doesn't use a regularly scheduled shift (vacation, visiting relatives, a day off), the shift is still billed at the standard rate unless released at least 7 days in advance — the same as daycare or preschool tuition. Guaranteed hours do not apply when the Nanny is unavailable or cancels.

7. Mileage & Activity Reimbursement

Mileage for Family driving (transporting children, approved errands) reimbursed at the current IRS standard mileage rate. Pre-approved activity costs (admission, supplies, meals out with the children) reimbursed by the Family with receipts. Reimbursements are itemized and due with the next regular payment.

8. Monthly Check-In

The Nanny and Family hold a brief monthly check-in to review how care is going, upcoming schedule needs, and any adjustments to this Agreement. When the relationship and schedule have been consistent, it's held in person; when scheduling has been irregular, by text, email, or phone. Both parties approach these conversations with openness and good faith. (The Better Nanny sends a monthly check-in form to support this.)

9. Trial Period & Termination

Trial period: the first two (2) scheduled sessions with a new Family. During the trial, either party may end the arrangement for any reason without notice or severance — other than payment for hours already worked.

Notice period: 14 days (two weeks) written notice, either direction.

Immediate termination (no notice) for: abuse, neglect, or misconduct involving any child; theft or destruction of property; breach of confidentiality; any illegal activity.

Severance: if the Family terminates without the required 14 days' notice (except for cause above), the Family pays severance equal to two (2) weeks of pay, calculated from the Family's average weekly scheduled hours over the preceding four (4) weeks at the current hourly rate.

10. Confidentiality & Privacy

The Nanny keeps all Family information strictly confidential — schedules, routines, personal matters, home address, alarm codes, security details, financial information, and photos/videos of the children — and will not post photos or information about the children or Family on social media without express written permission. This obligation survives termination.

Exceptions: immediate threats to a child's or Family's health, safety, or welfare (e.g., calling 911); disclosures required by Oregon mandatory reporting laws for suspected child abuse or neglect; or information compelled by a court or government agency (the Nanny will promptly notify the Family unless prohibited by law).

11. General Terms

Amendable at any time with written consent of both parties. Represents the entire understanding between the parties. Disputes: good-faith communication before legal remedies. Governed by the laws of the State of Oregon. The Nanny is an independent contractor; nothing here creates an employer-employee relationship unless separately established.

12. Signatures

By signing, both parties agree to all terms and conditions.
